Abstract: A large majority of the US Senate is sending flag amendment to the states for its approval by representatives of the people, but a few swing senators are coming up with old excuses for stifling a uniquely democratic process of constitutional lawmaking. The excuses given by the swing senators for curbing the flag-protection amendment are discussed.
