AbstractThis paper examines the recently enacted Food Safety Modernization Act and its effects on small-scale farmers/processors and food importers. Part I examines the exceptional treatment given to small-scale producers and farmers. Part II discusses the heightened regulation of imported foods. Part III demonstrates that the decision to heighten import regulation while providing exemptions for small-scale producers was not predicated on a scientific risk analysis, and argues that this regulatory scheme leaves significant gaps in the food safety system.
