Abstract

This thesis focusses on the desire for individuals to continue maintaining virtual existences after natural death and future implications for intellectual property rights law. It highlights the conditions that currently exist on the precipice of policy and federal regulation of how a decedent’s digital estate is managed and produces engagement for the platforms in cyberspace. Bringing a critical explanation of digital estates and how they intersect with a lagging legal system is essential when considering protecting our freedom of speech well after death.
